Terms of Use

These Terms of Use ("Terms") govern access to and use of the sortmyprep website and related services, including our web app, mobile experiences (if any), WhatsApp/community channels (where applicable), and any features such as AI-based assistance, solution libraries, practice tools, tutor booking, counselling session listings, or similar offerings (collectively, the "Platform").

By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal data. By using the Platform, you acknowledge that you have read and understood the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

1. Eligibility, Minors, and Parent/Guardian Consent

1.1 Age. If you are under 18 years, you may use the Platform only with the consent and supervision of a parent/legal guardian.

1.2 Parent/Guardian Responsibility. If you are a parent/legal guardian allowing a minor to use the Platform, you agree that:

  • you are providing consent for collection/use of the minor's data as described in our Privacy Policy;
  • you supervise the minor's use of the Platform; and
  • you are responsible for the minor's compliance with these Terms.

1.3 Children's data practices. We do not knowingly conduct targeted advertising to children, and we do not knowingly perform tracking or behavioural monitoring of children beyond what is strictly necessary to provide the Platform, maintain security, prevent fraud/abuse, and comply with law.

1.4 Verification. We may implement age/guardian verification steps and may suspend/terminate accounts if we cannot reasonably verify consent where required.

1.5 Additional protections for children. Where required under applicable laws in a user's jurisdiction, including child data protection laws, sortmyprep may require verifiable parental or guardian consent before permitting minors to access certain features. sortmyprep reserves the right to restrict, suspend, or delete accounts where required consent cannot be reasonably verified.

2. Account Registration and Security

2.1 Account Creation. To access certain features, you may need to create an account and provide accurate information.

2.2 One user, one account. Accounts are for individual use. You must not share, sell, transfer, or permit third-party use of your account.

2.3 Security. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately of unauthorised access.

2.4 Suspension/Restriction. We may restrict or suspend access for security, suspected fraud, misuse, legal compliance, or Platform integrity reasons.

3. Services, Educational Nature, and No Professional Advice

3.1 Educational Purpose. sortmyprep provides educational tools and learning support.

3.2 Not professional advice. Content and tools are for general educational information and do not constitute professional advice (academic counselling, legal, medical, financial, immigration, or otherwise). You should obtain professional advice where needed.

3.3 No guarantees. We do not guarantee grades, admissions outcomes, exam scores, or specific results. Learning outcomes depend on multiple factors beyond our control.

4. AI Features and Output Disclaimers

4.1 AI-generated content. Certain features of the Platform may use artificial intelligence or automated systems to generate explanations, answers, recommendations, summaries, or other outputs ("AI Outputs").

4.2 Educational purpose only. AI Outputs are provided solely for educational assistance and do not constitute professional advice or guaranteed academic guidance.

4.3 Academic integrity. Users must not use AI features to facilitate cheating, plagiarism, academic misconduct, or violations of examination body rules.

4.4 Monitoring and safeguards. sortmyprep may implement monitoring mechanisms to detect misuse of AI tools and may suspend or restrict access where misuse is detected.

5. Intellectual Property and Permitted Use

5.1 Our IP. The Platform and all associated content (including text, solution formats, question banks, analytics, UI/UX, brand assets, proprietary workflows, and software) are owned by ZKAP or licensed to ZKAP ("sortmyprep Content").

5.2 Limited licence. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use sortmyprep Content only for your personal, non-commercial educational use.

5.3 Prohibited actions. You must not:

  • copy, reproduce, redistribute, resell, rent, sublicense, publish, or commercially exploit sortmyprep Content;
  • scrape, crawl, or use automated systems to extract content (except normal search engine indexing where permitted);
  • reverse engineer, decompile, or attempt to discover source code or underlying models/algorithms except to the extent permitted by law;
  • remove proprietary notices.

5.4 Third-party content. Some materials may be provided by third parties. You must respect their rights and usage restrictions.

6. Intellectual Property Complaints

sortmyprep respects the intellectual property rights of others. If you believe that content available on the Platform infringes your intellectual property rights, you may notify us by sending written notice to info@sortmyprep.com including:

  • identification of the copyrighted work claimed to be infringed;
  • identification of the allegedly infringing content;
  • contact information of the complainant; and
  • a statement made in good faith that the use is not authorised by the rights holder.

sortmyprep may investigate such claims and remove or restrict access to allegedly infringing material where appropriate.

7. User Submissions and Community Conduct

7.1 User content. If you upload or submit content (questions, solutions, chats, files, images, voice notes, etc.) ("User Content"), you represent you have the right to share it.

7.2 Licence to us. You retain ownership of your User Content. However, by submitting or uploading User Content, you grant ZKAP a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for technical compatibility), and display such content solely for the purpose of operating, maintaining, and improving the Platform and ensuring safety, legal compliance, and service functionality. Any use of User Content for analytics, safety, or improving AI features (if applicable) will be handled as described in the Privacy Policy, including any choices/consents required by law.

7.3 Code of conduct. You must not:

  • harass, bully, or abuse others;
  • share illegal, harmful, hateful, obscene, or defamatory content;
  • upload copyrighted content you don't have rights to;
  • attempt to gain unauthorised access to systems;
  • distribute malware;
  • spam, solicit, or impersonate.

7.4 Moderation. We may remove content, restrict features, suspend/terminate accounts, or take other actions if we believe content or conduct violates these Terms or applicable law.

8. Payments, Subscriptions, Taxes, and Invoices

8.1 Pricing. Prices (if/when applicable) will be shown on the Platform or communicated in writing. Prices may change.

8.2 Taxes. Prices may be exclusive of applicable taxes unless stated otherwise. GST treatment will be as per law.

8.3 Payments. Payments may be processed by third-party payment processors. You agree to their terms and acknowledge we are not responsible for their downtime or errors.

8.4 Invoices. Tax invoices may be issued as per applicable law and your provided billing details.

8.5 Chargebacks and payment disputes. If a payment is reversed, disputed, or charged back through a payment provider, sortmyprep reserves the right to suspend access to the relevant services until the dispute is resolved.

9. Refunds and Cancellations (Template)

9.1 Refund Policy. Refund eligibility and timelines, if applicable, will be specified at the time of purchase or within a separate Refund Policy made available on the Platform. Any refund decisions shall remain subject to applicable consumer protection laws that cannot be excluded by contract.

9.2 Tutor/counsellor sessions. For any third-party sessions listed/arranged via the Platform, cancellation/reschedule/ no-show rules may differ and will be disclosed before booking.

10. Third-Party Services, Counsellors, Tutors, and External Links

10.1 Third-party providers. The Platform may connect you with third-party tutors/counsellors or link to external websites. These are not controlled by ZKAP.

10.2 No endorsement. Links or listings do not constitute endorsement. You use third-party services at your own risk and on their terms.

10.3 No responsibility for outcomes. ZKAP is not liable for the acts, omissions, advice, or outcomes of third parties.

11. Privacy and Data Protection

11.1 Privacy Policy governs personal data. Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

11.2 Applicable laws. We aim to comply with applicable data protection laws depending on the user's location and the nature of processing, including India's Digital Personal Data Protection Act, 2023 (DPDP), and where applicable, laws such as the EU GDPR/UK GDPR and child protection rules (including COPPA in the United States).

11.3 Children/minors. Where required, we may request verifiable parent/guardian consent and may restrict features for minors.

11.4 Cross-border transfers. If personal data is transferred outside a user's country, we will use appropriate safeguards where required under applicable law (as described in the Privacy Policy).

11.5 Data requests. Requests to access/correct/ delete personal data (and other rights, where applicable) can be made as described in the Privacy Policy and via the grievance/contact details in these Terms.

12. Availability, Security, and Service Changes

12.1 Availability. We do not guarantee uninterrupted access. Maintenance, updates, or outages may occur.

12.2 Security. While we use reasonable safeguards, no system is perfectly secure. You use the Platform at your own risk.

12.3 Changes. We may modify or discontinue any part of the Platform at any time.

13. Force Majeure

sortmyprep shall not be liable for failure or delay in performance resulting from events beyond its reasonable control, including but not limited to internet outages, cyber incidents, natural disasters, government actions, or failures of third-party service providers.

14. Disclaimers

14.1 No warranties. To the maximum extent permitted by law, the Platform and sortmyprep Content are provided "as is" and "as available" without warranties of any kind (including accuracy, fitness for purpose, or non-infringement).

14.2 Accuracy. We do not warrant that content is error-free or fully aligned to every board/mark scheme. Always validate against official syllabus/mark schemes and teacher guidance.

15. Limitation of Liability

15.1 Indirect losses. To the maximum extent permitted by law, ZKAP shall not be liable for indirect, incidental, special, consequential, or punitive damages.

15.2 Liability cap. To the maximum extent permitted by law, ZKAP's aggregate liability for claims relating to the Platform shall not exceed the amount paid by you to ZKAP in the three (3) months preceding the event giving rise to the claim. If you have not paid us any amount for the relevant services, our total liability shall be limited to INR ₹2,000.

15.3 Non-excludable rights. Nothing in these Terms limits rights or remedies that cannot be excluded under applicable law.

16. Indemnity

You agree to indemnify and hold harmless ZKAP, its directors, officers, employees, and contractors from claims, losses, and expenses arising out of:

  • your breach of these Terms;
  • your misuse of the Platform;
  • your infringement of third-party rights; or
  • unlawful content you submit.

17. Termination

We may suspend or terminate your access immediately if we believe you violated these Terms or created legal/security risk. You may stop using the Platform at any time. Clauses relating to IP, confidentiality (where applicable), disclaimers, liability, and dispute resolution survive termination.

Users may submit complaints, concerns, or data protection requests to:

sortmyprep will acknowledge receipt of complaints within seventy-two (72) hours and will endeavour to resolve grievances within fifteen (15) business days, subject to applicable law.

19. International Use and Data Processing

The Platform may be accessed by users from multiple jurisdictions. Personal data may be processed in India or other countries where our service providers operate. By using the Platform, you consent to such processing in accordance with our Privacy Policy and applicable data protection laws.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have jurisdiction, subject to any mandatory consumer protections.

21. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the Platform with a revised "Last Updated" date. Continued use after updates means you accept the updated Terms.

22. Cookies and Analytics

The Platform may use cookies and similar technologies to maintain user sessions, improve functionality, analyse platform usage, and enhance user experience. Users may manage cookie preferences through their browser settings. Additional information regarding cookies and tracking technologies is described in our Privacy Policy.
